Massachusetts General Laws c. 229, section 2, is a statutory law that sets forth the legal causes of action for wrongful death.  The statute provides that a wrongful death action may be brought against a person or corporation who by his or its negligence causes the death of a person or by willful, wanton or reckless act causes the death of a person under such circumstances that the deceased could have recovered damages for personal injuries if his death had not resulted.  The person or corporation shall be liable in damages.  Proof of conduct that rises to the level of willful or reckless acts may give rise to punitive damages against the wrongdoer.

The statutory law also sets forth the beneficiaries who are entitled to the damages recovered in Massachusetts General Laws c. 229, section 1.  These beneficiaries are the spouse and children of a married decedent or the next of kin of an unmarried decedent.

In addition to recovery under the wrongful death statute, there is a cause of action for conscious pain and suffering for the period of time between the injury suffered in the accident and the time of death. This is considered an asset of the estate of the decedent.
